Courtroom Fantasy
I picture it like a dream sequence, there I am in bed falling asleep and the lines of my mind start to waver like the air of a desert mirage.
"Defendant you may now cross examine the witness" the judge spoke clearly in the stogy air of the courtroom
The defendant rose, confident his eye gleaming a bit, his college acting classes being slightly recalled in his brain. This man had an idea of how to put on a good show.
"Officer could you tell us the circumstances of the night on which the offenses at hand occurred?"
Clearing his throat "yes it was late on October 13th, it was a Friday and I was conducting my ordinary rounds, and was stopped at a stoplight."
"Go on, then what happened?"
"Then as I was waiting in the oncoming lane I saw a biker go through the intersection at a considerable speed, and I then proceeded to pull a U-Turn to speed up and pull him over for running the red light."
"And did you pull him over?"
"yes two and a half blocks down after he had taken a right turn and he was a quarter of the block up"
"Had he stopped biking?"
"yes"
"he was waiting for you then?"
"Yes after the two block chase?"
"Why do you consider it a chase? wasn't he stopped?"
"Yes but only two blocks later."
"would it have been possible that he didn't know your sirens were for him? have you never encountered a unobservant driver who took two blocks to pull over?"
"Yes but he seemed to have sped up"
"I see but it may have been possible that he was unaware your sirens were meant for him?"
"Yes it's possible."
"Let me ask you this officer, you viewed the bicyclist as a vehicle of the road correct, not a pedestrian?"
"Yes that's correct."
"Yet the citation you wrote claims the offense was fleeing on foot. correct?"
"Yes that's what I wrote."
"At what point did the defendant stop becoming a vehicle and become a pedestrian?"
"When he dismounted his bicycle, I imagine"
"Did the defendant try to avoid your apprehension after his dismounting of his bicycle?"
"No"
"just to further my point about your definition of vehicle as apposed to pedestrian. Have you ever seen people bicycling on the sidewalk?"
"Yes"
"Were you aware that this against the law?"
"I guess so yes"
"Have you ever written a ticket for a bicyclist on the sidewalk?"
"No I haven't"
"would you pull over a motorcycle or car if you saw it driving on the sidewalk?"
"yes probably I would."
"So at what point does bicyclist become a vehicle that abides to traffic laws rather then pedestrian laws?"
"Well the moment he enters the roadway."
"So if my client were have crossed the roadway during the red light in the crosswalk from sidewalk to sidewalk, would you then have instead considered it jaywalking?"
"Yes I would have"
"So as a bicyclist, the least amount of traffic laws that you must abide by are found on the sidewalk, by your definitions correct?"
"Yes I suppose"
"Wouldn't this encourage a bicyclist to bike on sidewalks and crowd pedestrians?"
"perhaps"
"Well my point is officer, my client would not have been guilty of fleeing on foot by your standards, nor would your claim that he was driving on the right side of the road as he was dismounted by that time and was therefore a pedestrian by your standards."
"Oh yeah I guess"
All in all, being cuffed on my belly on the road was quite a learning experience of the power relationship that many of our innocent till proven guilty criminals face. Also I am learning quite a lot about the sloth of our justice system, as my citation has yet to be available in the county computers, and was issued on Friday evening.
Civil Disobedience on bike should be done in disobedience to the laws not in retaliation to motorists, it's not them who create the problems. It's the lack of the city and laws to give equal rights to a transportation method that historically was marginalized by the invention of consumption combustion engines. Bicycling should instead be encouraged for it's non-consumptive nature. The obesity problem in our country could also be helped if bicycling was encouraged by our government.
They give tax breaks for the purchase of hybrid vehicles, that still consume energy and drain natural resources of oil and electricity. I don't see a tax break given for the purchase of bicycles, as they are considered secondary transportation, it's a stretch but some what applicable to correlate second class citizen ideas, to bicyclist being considered second class transportation, and therefore should demand equal rights.
